1. Introduction
Welcome to Alter Cabs, operated by Append Mobility Private Limited (“Company,” “we,” “us,” or “our”). By accessing or using our mobile application (“App”) and related services (“Services”), you agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree with these Terms, please do not use our Services.
2. Definitions
• “Service”: The ride-hailing and related services provided through the Alter Cabs App.
• “User”: Any individual who uses the Alter Cabs App, including both riders and drivers.
• “Driver”: An individual authorized to provide transportation services via the Alter Cabs platform.
• “Rider”: An individual who requests or uses transportation services through the Alter Cabs App.
3. Eligibility
To use our Services, you must be at least 18 years old and capable of entering into legally binding agreements. Drivers must possess a valid driver’s license, appropriate insurance, and meet all local regulatory requirements.
4. User Accounts
• Registration: Users must create an account by providing accurate and current information.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Account Suspension/Termination: We reserve the right to suspend or terminate accounts for violations of these Terms or any misuse of our Services.
5. Booking and Cancellation
• Ride Requests: Riders can request rides through the App, and we will endeavor to connect them with available Drivers. However, availability is not guaranteed.
• Cancellations by Riders: Riders may cancel a ride request within a specified timeframe without incurring charges. Cancellations outside this period may result in a fee.
• Cancellations by Drivers: Drivers may cancel a ride for valid reasons, including safety concerns or Rider no-shows.
6. Fees and Payments
• Fare Estimates: The App provides fare estimates, which may vary based on factors such as traffic and route changes.
• Payment Methods: Payments are processed through the App using the payment method selected by the User (e.g., credit card, digital wallet).
• Additional Charges: Additional fees may apply for services such as wait times, tolls, or cleaning fees in case of damage or spillage.
7. User Conduct
• Riders: Must respect Drivers and their vehicles, avoid causing damage, and comply with all applicable laws during the ride.
• Drivers: Must provide safe, clean, and lawful transportation services and comply with all applicable laws and regulations.
• Prohibited Activities: Users are prohibited from engaging in illegal activities, harassment, or any behavior that compromises the safety and integrity of the Service.
8. Limitation of Liability
Alter Cabs acts as an intermediary connecting Riders and Drivers. We are not liable for the conduct of Users or any incidents that occur during rides. Our liability is limited to the maximum extent permitted by law.
9. Privacy
We are committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and disclose personal data.
10. Amendments
We may update these Terms from time to time. Changes will be effective upon posting on our App. Continued use of the Services after such changes constitutes acceptance of the new Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or the use of our Services shall be resolved through arbitration in Chennai, India, in accordance with applicable laws.
